Terms of Service

These Terms of Service (“Terms”) govern access to and use of the private Meta-integrated application operated by Speak Like a Professional, LLC (“Company,” “we,” “our,” or “us”).

By accessing, authorizing, or using this application, you agree to be bound by these Terms. If you do not agree, do not access or use the application.

1. Nature of the Application

This application is a private internal-use tool developed and maintained by Speak Like a Professional, LLC for limited business purposes, including retrieval of Meta account data, analytics, and insights for internal reporting, performance evaluation, and related operational purposes.

This application is not offered to the general public and confers no right of public access or use.

2. Eligibility and Authorized Use

You may use this application only if:

  • you are authorized by Speak Like a Professional, LLC to use it;

  • you have authority to connect the relevant Meta account, Page, business asset, or advertising account; and

  • your use complies with these Terms, Meta’s terms, and applicable law.

Unauthorized access or use is strictly prohibited.

3. Permitted Use

The application may be used solely for legitimate internal business purposes authorized by the Company, including:

  • retrieving Meta account and performance data;

  • reviewing business insights and analytics;

  • supporting internal marketing, reporting, and strategic decision-making; and

  • other limited internal functions approved by the Company.

You may not use the application for resale, sublicensing, public distribution, surveillance, competitive misuse, unlawful profiling, or any purpose outside the Company’s authorized internal business operations.

4. Meta Platform Relationship

This application interoperates with Meta platforms and services, but Meta does not own, operate, endorse, or assume responsibility for this application except to the extent required by Meta’s own terms and policies.

Your use of the application may also be subject to:

  • Meta Platform Terms

  • Meta Developer Policies

  • Meta’s applicable privacy, data, and account terms

If there is a conflict between these Terms and mandatory Meta platform requirements, the Meta requirements control only to the extent required.

5. Account Connections and Permissions

By connecting a Meta account or authorizing requested permissions, you represent and warrant that:

  • you are authorized to grant such access;

  • all information provided is accurate;

  • the permissions granted are lawful and appropriate; and

  • your authorization does not violate any agreement, duty, or law.

You are responsible for reviewing the permissions requested before granting access.

6. Data Access and Use

The application may access and process certain Meta account data, including business account identifiers, campaign data, engagement metrics, performance analytics, and similar account-level information necessary for the application’s internal functions.

All data use is subject to our Privacy Policy and Data Deletion Instructions, each of which is incorporated into these Terms by reference.

7. AI-Assisted Processing

The application may use automated tools, including AI-assisted systems, to organize, summarize, analyze, and report on retrieved data for internal business purposes.

You acknowledge and agree that:

  • AI-generated outputs may contain errors, omissions, or inaccurate inferences;

  • such outputs are provided as decision-support tools only;

  • the Company does not guarantee the completeness, accuracy, or fitness of AI-generated insights for any specific purpose; and

  • human review remains necessary for material business, legal, financial, advertising, or compliance decisions.

8. No Professional Advice

The application and any outputs it generates, including analytics summaries, recommendations, or AI-assisted interpretations, are provided for informational and internal operational purposes only.

They do not constitute legal, tax, accounting, regulatory, medical, mental health, investment, or other professional advice. Any important decision should be evaluated independently and, where appropriate, with qualified professional advisors.

9. User Responsibilities

You agree that you will not:

  • use the application in any unlawful, fraudulent, deceptive, or unauthorized manner;

  • attempt to gain unauthorized access to systems, accounts, tokens, or data;

  • interfere with the operation, security, or integrity of the application;

  • copy, reverse engineer, modify, or create derivative works from the application except as permitted by law and expressly authorized in writing;

  • use the application to infringe privacy, intellectual property, or contractual rights; or

  • use the application in a way that violates Meta’s policies or applicable law.

10. Suspension or Termination

We may suspend, restrict, or terminate access to the application at any time, with or without notice, for any reason, including suspected misuse, security concerns, policy violations, legal risk, technical issues, or discontinuation of the application.

We are not liable for any loss arising from such suspension, restriction, or termination.

11. Intellectual Property

The application, including its design, workflows, text, software logic, analytics structure, documentation, and related materials, is owned by or licensed to Speak Like a Professional, LLC and is protected by intellectual property and other applicable laws.

No license or ownership right is granted except the limited right to use the application as expressly authorized under these Terms.

12. Confidentiality

Any non-public information made available through the application, including business metrics, internal analytics, workflows, reports, system design, and related materials, is confidential and may not be disclosed, copied, or used except as expressly authorized by the Company.

13. Security

We use reasonable safeguards for the application, but we do not warrant that the application will be uninterrupted, error-free, or completely secure.

You are responsible for maintaining the security of any devices, credentials, accounts, and systems used in connection with the application and for promptly reporting suspected unauthorized access or misuse.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION IS PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  • THE APPLICATION WILL MEET ALL NEEDS OR EXPECTATIONS;

  • DATA AVAILABLE THROUGH META WILL ALWAYS BE AVAILABLE, COMPLETE, OR ACCURATE;

  • THE APPLICATION WILL OPERATE WITHOUT INTERRUPTION OR ERROR; OR

  • ANY DEFECTS OR ISSUES WILL ALWAYS BE CORRECTED.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAK LIKE A PROFESSIONAL, LLC AND ITS OWNER, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE APPLICATION OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF SPEAK LIKE A PROFESSIONAL, LLC ARISING OUT OF OR RELATING TO THE APPLICATION OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

16. Indemnification

You agree to defend, indemnify, and hold harmless Speak Like a Professional, LLC and its owner, officers, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your access to or use of the application;

  • your violation of these Terms;

  • your violation of Meta’s terms or applicable law;

  • your lack of authority to grant account access or permissions; or

  • your infringement or misuse of any third-party rights, accounts, or data.

17. Compliance and Record Retention

Nothing in these Terms requires the Company to delete or destroy information that it is permitted or required to retain for legal, regulatory, tax, accounting, security, fraud prevention, dispute resolution, backup, archival, or enforcement purposes.

18. Modifications to the Application or Terms

We may modify, suspend, or discontinue any part of the application at any time. We may also update these Terms from time to time by posting revised Terms with a new Effective Date.

Continued use after updated Terms are posted constitutes acceptance of the revised Terms.

19. Governing Law

These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles.

20. Venue

Any dispute arising out of or relating to these Terms or the application shall be brought exclusively in the state or federal courts located in [Insert County, State], and you consent to the personal jurisdiction and venue of those courts.

21. Severability

22. Entire Agreement

These Terms, together with our Privacy Policy and Data Deletion Instructions, constitute the entire agreement regarding the application and supersede prior or contemporaneous understandings relating to the subject matter herein.
